Apple is suing Samsung who is suing Apple who sued Google who was sued by Yahoo who is suing Facebook and they are all trolling for patents. But enough with the day jobs Silicon Valley worker bees, try going skiing.....if you're lawyer allows you to go.

ALPINE MEADOWS RELESE OF LIABILITY

CONDITIONS OF ISSUANCE FOR ALL ALPINE CLUB MEMBERSHIPS Your Alpine Club Membership (“Pass”) is for your use and enjoyment. Listed below are some rules and guidelines we hope will make your experience more enjoyable. This is only a partial list, use common sense and good judgment.........If I travel beyond the ski area boundary, I agree to assume all risks associated with backcountry travel, including the risk of avalanches. I understand that I may be charged for any rescue, if available, beyond the boundary. 4. I WILL always observe and obey all posted signs, warnings, the SKI AREA RESPONSIBILITY CODES, and all other ski area rules. 5. I UNDERSTAND that violating any safety rule may result in the immediate loss of all skiing/snowboarding privileges and possible criminal prosecution under California Penal Code sections 653i and 602(r), including possible fines and jail time. 6. I UNDERSTAND that use of my Pass by anyone other than myself or use at any time other than designated by the Pass will constitute FRAUD and will result in the immediate loss of all privileges without compensation. 7. I UNDERSTAND that if I lose my Pass or if it is stolen, I must notify the special tickets desk, and at the resorts’ discretion, the Pass may be replaced for a $50.00 fee. If I forget my Pass on any given day, I will have to purchase a lift ticket for that day. 8. I UNDERSTAND that my Pass and privilege to use the facilities of the ski area may be revoked at any time (without compensation) by Ski Patrol or Management for violations of this agreement or ski area rules. 9. I UNDERSTAND that Alpine Meadows and or Homewood Mountain Resort reserve the right to restrict the use of my pass for any reason.........Despite the risks involved in the activities and as consideration for being allowed to participate in the activities, I AGREE TO EXPRESSLY ASSUME ANY AND ALL RISK OF INJURY OR DEATH which might be associated with my participation in the activities and use of the facilities of Alpine Meadows, including use of terrain parks, chairlifts, rental equipment, instruction, racing, traveling beyond the ski area boundary, and all special events (hereinafter collectively referred to as “use of the facilities”). I AGREE NEVER TO SUE AND TO RELEASE FROM LIABILITY Alpine Meadows Ski Resort, Alpine Sierra Ventures, LLC, JMA Alpine Manager, LLC, Homewood Mountain Resort, Homewood Village Resorts, LLC, Homewood Operations Management, LLC, JMA Ventures, LLC, the United States Of America, Department of Agriculture, Forest Service, and their owners, officers, directors, employees, agents, landowners and affiliated companies (hereinafter collectively referred to as “Alpine Meadows”) for any damage, injury or death to me arising from my participation in the activities and my use of the facilities at Alpine Meadows regardless of cause, including the alleged NEGLIGENCE of Alpine Meadows. I understand this is a RELEASE FROM LIABILITY which will prevent me or my heirs from filing suit or making any claim for damages in the event of injury or death to me. Additionally, in the event I file or my child, the user, or my legal representative files a claim or a lawsuit arising out of the activities or the use of the facilities, I AGREE TO DEFEND, INDEMNIFY AND HOLD HARMLESS Alpine Meadows, for any damages, attorney’s fees or costs arising out of such a claim or lawsuit. With the aforesaid fully understood, I nevertheless enter into this agreement freely and voluntarily and agree that it is binding upon me, my child, the user, my heirs, assigns and legal representatives. I understand and agree that this agreement will be interpreted under California law and I consent to the exclusive jurisdiction of the California courts. I understand that this agreement is severable. If any clause is found to be invalid, the balance of the contract will remain in effect, valid, and enforceable.

New Year's Predictions for 2011

I'll make this one short.

2011 Prediction #1: 1Q2011 & 2Q2011 will record breaking numbers for AAPL. I've put my money where my mouth is and loaded up on Apple stock (even though Apple's failure to fix any significant MacOS bugs in 2010 is quite irksome).

2011 Prediction #2 is actually 2012 Prediction #1: But, as an independent, I feel compelled to call the shot now. In 2012, its Obama in a landslide. With his current strategic position, only Team Obama can defeat the incumbent President.
